1. ATV Usage
Guests may use the ATV(s) provided by ATV Berat solely for recreational purposes during the designated ATV tour.
2. Responsibility for Damages
Outer Side Damage:
Guests are responsible for any damages incurred to the outer side of the ATV, including but not limited to plastic components, mirrors, etc., during the ATV tour. Guests are not responsible for any mechanical issues, including motor problems, tire problems, or any other mechanical issues.
3. Safety Guidelines
Guests must adhere to all safety guidelines and instructions provided by the ATV tour instructors. Failure to do so may result in the termination of the tour without a refund.
4. Liability
ATV Berat is not responsible for any harm, injury, or damage incurred by guests as a result of failing to follow the rules and instructions provided during the ATV tour.
5. Indemnification
Guests agree to indemnify and hold harmless ATV Berat, its affiliates, employees, and agents, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to their use of the ATV(s).
6. Agreement Acknowledgement
By signing this Agreement, guests acknowledge that they have read, understood, and agreed to all terms and conditions outlined herein. 7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising under or in connection with this Agreement shall be resolved exclusively by the courts of [Jurisdiction].
